The assault & battery laws and penalties in Florida are as follows:

  • Assault:  intentionally threatening to commit violence against another person in a way that creates a well-founded fear that violence is imminent.  Assault is a second degree misdemeanor and is punishable by up to 60 days in jail and a $500 fine.
  • Aggravated Assault:   committing assault with a deadly weapon or committing assault with intent to commit a felony. Aggravated assault is a third degree felony and is punishable by up to 5 years in prison and $5,000 in fines.
  • Battery:  intentionally touching or striking another persona against their will, or intentionally causing bodily harm to another person. Battery is a first degree misdemeanor, punishable by up to one year in jail and $1,000 in fines.
  • Aggravated Battery:  any person who commits battery with the intent to cause great bodily harm, permanent disability, or permanent disfigurement, or who commits battery with the use of a deadly weapon.  It is also felony battery to commit battery against a woman that the defendant knows is pregnant.  Aggravated battery is a second degree felony, and is punishable by up to 15 years in prison and $10,000 in fines.
  • Felony Battery: intentionally touching or striking another person against their will, and by doing so causing great bodily harm, permanent disability, or permanent disfigurement.  Felony battery is punishable by up to 5 years in prison and $5,000 in fines.
