Murder is defined as the unlawful killing of another human being.  When murder is premeditated, meaning the offender took steps to plan to kill the victim, he or she will be charged with first degree murder.   A person doesn’t have to spend weeks or months planning a murder to be charged with murder of the first degree.  A person will face first degree murder charges even if the murder was planned minutes or seconds before the crime took place. Second degree murder is not premeditated, but was intentional.  While second degree murder is a lesser offense, the penalties are still severe.  Anyone found guilty on second degree murder charges will face up to 30 years in prison and $10,000 in fines.  First degree murder is punishable by a lifetime in prison, with some cases punishable by death.
